In an Accident Caused by a Drunk Driver? Here's What to Do Next

May 17, 2022

Unfortunately, drunk driving is more common than many of us even realize, and certainly more common than it should be. According to the National Highway Traffic Safety Administration, over 1.5 million people are arrested for DUIs every year. Now, not all drunk driving incidents result in a car accident, but many do. Driving under the influence impairs your judgment and ability to assess as you drive, making you more likely to get into a car accident. Even worse, these accidents often involve people who were not driving under the influence.

But what happens if you were in an accident caused by a drunk driver? Whether you were a passenger, a driver in another car, or a passerby, you have options. Let's look into what your next steps should be below.

1. Call the Police

As any
car accident lawyer will tell you, it's important that there is a police report on file, even if nobody was injured. Call the police and tell them that you were in an accident caused by a drunk driver. If anyone was injured in the accident, tell them that they need to send an ambulance.

2. Don't Talk to the Drunk Driver

Until the police arrive at least, do not talk to the drunk driver. People under the influence can be angry or belligerent, especially in a high-pressure situation, and you do not want to antagonize them or get caught up in a further crisis. Taking to the driver can also be a legal liability so it's better to not exchange any words. Of course, if the driver is injured and in distress, you can let them know that help is on the way.

3. Take Photos

If you can, start taking photographs of the accident. If you are able to take photos of the scene, this could help your car accident lawyer prepare your case down the road. Consider these photos evidence, and take as many of them as possible.

4. Get Information

If there are witnesses, get their names and phone numbers if possible. Additionally, get the drunk driver's name, as well as their license plate number, address, driver's license number, and insurance information.

5. Call A Lawyer

As soon as you are able, get in touch with a car accident lawyer. Do not assume that you can pursue legal action on your own. Just because you legally can doesn't mean that you should. A lawyer can help you pursue justice and get compensation for the damages incurred. Call an attorney immediately after your accident.

No one wants to be in a car accident but it is better to be prepared in case you are. Following these steps will help you get the assistance you need following a car accident. Contact Jim Beard Attorney at Law if you or a loved one have been in a car accident with a drunk driver.
